Privacy Policy

This policy applies to visitors to the Site and people who contact us through the Site, by email, or by phone. Toms River SEO decides why and how information is used for these activities. Service providers process information for us as described below. The Site is operated from Toms River, New Jersey and is intended primarily for businesses and visitors in the United States. This policy does not apply to a third-party website or service that is linked from the Site and operates under its own privacy notice.

We do not intentionally collect precise geolocation, payment-card credentials, government identifiers, health information, or other sensitive personal information through the Site. Please do not include sensitive information in an inquiry.

Information you provide

• Contact form. The form asks for your name, phone number, email address, and website. All four are required. We also receive the fact that you submitted the form and related follow-up communications.
• Direct communications. If you email or call us, we receive the information you choose to provide, such as contact details, the nature of your request, and communication content.

Information collected automatically

• Technical and device data. Internet Protocol (IP) address, general location inferred from IP, browser type, device type, operating system, language preference, and similar technical details.
• Usage and referral data. Pages viewed, referring page or source, approximate session duration, dates and times, navigation paths, and interaction events.
• Session-replay and heatmap data. Mouse movement, scrolling, clicks, page layout information, and usability events such as repeated or rapid clicks. Section 6 explains Microsoft Clarity and its masking controls.
• Cookies and browser storage. Pseudonymous identifiers and preferences stored through cookies, local storage, or session storage.

We use information for the following purposes:

• Respond to your inquiry, provide a requested free audit, and discuss potential services.
• Operate, host, secure, maintain, and troubleshoot the Site.
• Measure traffic, referrals, engagement, and Site performance.
• Understand how visitors navigate the Site and improve content, layout, forms, and usability.
• Detect, investigate, and prevent spam, abuse, fraud, security incidents, and technical problems.
• Comply with law, respond to lawful process, protect rights and safety, and establish or defend legal claims. We do not use a contact-form submission to enroll you in unrelated marketing messages unless you separately choose to receive them. The Site currently uses analytics for measurement and improvement, not for ads selected from your activity across unaffiliated websites.

The Site uses cookies and browser storage to operate platform features, remember preferences, distinguish browsers or sessions, and analyze usage. The following items were active as of the effective date:

Cookie and storage names may change as providers update their services. The Site currently relies on browser controls rather than an on-site cookie preference center, so analytics and platform storage may be set when a page loads. You can block or delete cookies and clear local or session storage in your browser. Blocking these technologies may affect Site functionality and will not necessarily prevent all server-side logging.

We may disclose information in the following circumstances:

• Hosting, forms, analytics, and email providers. Ploy receives Site and form data; Google and Microsoft receive technical and usage data; and the provider of our receiving mailbox receives copies of inquiries.
• Professional advisers. Lawyers, accountants, insurers, consultants, or other advisers may receive information when reasonably necessary and subject to appropriate duties.
• Legal, safety, and rights protection. We may disclose information to comply with law or valid legal process; respond to government requests; or protect the rights, property, security, or safety of Toms River SEO, visitors, or others.
• Business transaction. Information may be disclosed in connection with a proposed or completed merger, acquisition, financing, reorganization, bankruptcy, or sale of business assets, subject to customary safeguards.
• At your direction. We may disclose information when you ask or authorize us to do so. The categories disclosed to providers are contact and inquiry information, identifiers, technical data, internet or interaction activity, and general location derived from IP, as applicable to the service each provider performs.

Toms River SEO does not receive money in exchange for personal information. We do not use Site information to deliver advertisements selected from a visitor's activity over time across unaffiliated websites, and we do not use it for profiling that produces legal or similarly significant decisions. Ploy's site-level visitor enrichment is disabled. We use Google, Microsoft, and Ploy for the service-provider purposes described above. Some privacy laws define a "sale" or "sharing" broadly. If applicable law treats a disclosed practice differently, we will provide and honor the legally required choice.

We retain information for no longer than reasonably necessary for the purposes described in this policy, subject to the following practices:

• Standalone contact-form inquiries. We delete these from Ploy's submission records and the receiving mailbox within 90 days after receipt. If an inquiry becomes a client engagement, relevant information may instead become part of client or business records governed by separate retention practices. We may preserve a specific record longer when required by law or reasonably necessary for a legal claim.
• Microsoft Clarity. Microsoft states that playback data is retained for 30 days and click data, heatmaps, and labeled or favorited sessions for 9 months.
• Google Analytics. Event-level and user-level data is retained according to the retention setting configured for the relevant GA4 property. Google may retain standard aggregated reports separately from that setting.
• Browser storage and platform records. These remain until they expire, are cleared in the browser, are deleted under provider settings, or are no longer needed for platform, security, or legal purposes. Deletion from an active system may not immediately remove information from provider backups or security logs. Those copies may remain for a limited period under the provider's standard backup and deletion cycle.

We use reasonable administrative, technical, and organizational measures appropriate to the nature and volume of information we handle. These measures may include limiting access to the Ploy workspace and receiving mailbox, using provider security controls, and deleting standalone inquiries under the schedule above. No website, transmission, or storage system can be guaranteed completely secure, so please do not send sensitive information through the contact form or ordinary email.

Your choices

• You may browse the Site without submitting the contact form.
• You can block or delete cookies and clear local or session storage using browser settings. Some Site features may then work differently.
• You can use the Google Analytics opt-out browser add-on to prevent Google Analytics JavaScript from sharing visit activity with Google Analytics.
• You may ask us to stop follow-up communications about an inquiry at any time.

Do Not Track and universal opt-out signals

Because there is no uniform industry standard for browser "Do Not Track" signals, the Site does not currently respond to those signals. Google, Microsoft, and Ploy may collect information about Site activity as described in this policy, and their services may recognize browsers across websites subject to their own policies and settings. We do not currently sell personal information or process it for cross-site targeted advertising. If applicable law requires us to recognize a valid universal opt-out mechanism, such as a legally recognized opt-out preference signal, we will process it for covered activities as required.

Rights available under applicable law

Depending on where you live and whether a privacy law applies to us, you may have the right to confirm whether we process your personal information; access it; correct inaccuracies; delete it; receive a portable copy; or opt out of a sale, targeted advertising, or certain significant-effects profiling. You may also have the right not to receive discriminatory treatment for exercising a privacy right. Describe the right you want to exercise and provide enough information for us to locate the relevant record. We may request reasonable information to verify your identity and authority. You do not need to create an account. We will respond within the period required by applicable law. An authorized agent may submit a request where permitted by law, but we may ask for proof of authority and may verify the request directly with you. If we deny a request and applicable law provides an appeal right, reply with the subject "Privacy Appeal" and explain why you believe the decision should be reconsidered. If an appeal is denied, New Jersey residents may contact the New Jersey Division of Consumer Affairs.

The Site is a business-services website and is not directed to children under 13. We do not knowingly collect personal information from a child under 13. If you believe a child has submitted personal information, contact us so we can review and delete it as appropriate.

The Site may link to websites or services operated by others. Their privacy and security practices are governed by their own notices and are not controlled by Toms River SEO. Review the privacy terms of a third-party service before providing information to it.

We may update this policy to reflect changes in technology, providers, law, or our practices. We will post the revised version on the Site, change the "last updated" date, and provide additional notice when a change is material or when applicable law requires it.
